Marriage & Annulments
Some Catholics who go through a divorce process just decide for themselves
that they have no grounds for an annulment. At times, a Catholic might go
to a priest who will say that they have no grounds for an annulment.
Neither approach is advisable, the best route is to seek the advice of an
expert and let them decide what the grounds are. Every diocese has people
trained in Canon Law, particularly in marriage Tribunal work. They are the
best people to decide if there are grounds for an annulment. They will
listen to your story, if there are grounds for an annulment, they will
tell you. If there are no grounds, they will be honest with you.
Some divorced Catholics blame themselves or their former spouses for their
marriage break-up. The marriage Tribunal is not interested in whose fault
it is or who is guilty an who is to be punished. The marriage Tribunal
examines carefully whether the sacrament of matrimony is valid.
It often happens that a person will go to their parish priest who
discourages them because of lack of information or who may disapprove of
annulments. A Catholic need not stop there because they have a right to
present their petition to a marriage Tribunal for consideration. Sometimes
you as a Catholic have to do directly to the Marriage Tribunal office.
Every diocese has a marriage Tribunal office made up of pastors, religious
and laity with secretaries - like most offices. There is a presiding judge
who exercises power on behalf of the bishop. There are judges who are the
experts in Canon Law and they hear the cases and make the decisions. There
is a Defender of the Bond whose job it is to defend the laws of marriage
and make sure that if an annulment is granted it is given on solid legal
grounds. The Tribunal also has a Promoter of Justice who makes sure that
he proper procedure is followed from beginning to end. Sometimes this role
is assumed by the Defender of the Bond.
