COURT NEWS

-A 41 year-old Bell Island man was sentenced to a 21 day intermittent sentence along with a $50.00 fine when he plead guilty in Provincial Court to a charge of impaired driving.

-A 1 year driving suspension and a $600.00 fine was handed down to a 42 year-old Bell Island woman in Provincial Court. She was charged with refusing to provide a sample of her breath after being stopped by Police and found to be under the influence of alcohol.

-Police have charged a 64 year-old Bell Island man with sexual interference. The matter is before the courts at this time.

-A 1 year suspended sentence was handed down to a 21 year-old Bell Island male after he plead guilty in Provincial Court. He had been charged with Uttering Threats and Assault.

-Sentencing will be handed down on March 19th to a 38 year-old Bell Island man. He was charged with Assault and Breaching his Undertaking by police after 2 disturbances .

-Police charged a 43 year-old Bell Island man with Assault and Obstructing a Police Officer in connection with a New Year's Day incident. The matter is set for trial in August.

-A warrant of arrest has been issued for a 49 year-old former Bell Island man. He had been charged with impaired driving and failed to show for his court appearance.

-Charges of Break and Enter and Uttering Threats have been laid against a 35 year-old Bell Island man in connection with an incident at the Wabana Complex. The matter is still before the courts.

-A 36 year-old Bell Island woman will be sentenced in Provincial Court after she was charged with assault. The matter arose over a family dispute.

-18 months probation was given to a 15 year-old Bell Island youth in connection to a series of thefts from vehicles. His partner in crime, a 16 year-old youth received 6 months in jail in connection with this matter and a series of Break and Enters.

- Illegal possession of liquor charges against a 17 year-old Bell Island youth were laid by Police. The youth will appear in court for trial in March.

-Charges of Uttering Threats and breaching the conditions of his bail have been laid against a 36 year-old Bell Island man. He will be appearing in court in June.

-A 42 year-old Bell Island woman has been charged for Uttering Threats and breaching the conditions of her bail. She will be appearing in court to deal with the matter.

-Police charged a 57 year-old Bell Island man with impaired driving after a November 2002 incident. The matter is set for trial in June.


HOME BREW ALERT!

There have been recent incidents of people making and selling home brew to youths. One would have to think after the incident in Hare Bay a couple of years back that people both young and old would be a little wiser to the danger of this.

First of all to the people who are making it and selling it - How would you feel if the stuff you sell makes some kid sick or worse yet kills them?

To the people who are buying it - Do you know what's in it?

You may want to consider the consequences the next time you feel like indulging!

COMMUNITY INCLUSION COMMITTEE

During the Fall of 2002, a committee was put together on Bell Island, to be known as the "Community Inclusion Committee." This group was successful in obtaining funding to complete a project in the community, which would promote awareness of people with disabilities. Grade 4, 5, and 6 students at Immaculate Conception School were asked to participate in a poster contest. They were given a theme "Everyone Belongs in Our Community," and asked to draw a picture, showing people with disabilities being included in activities. Twelve posters were chosen and were printed in a 2003 calendar, currently on sale in the community for $5.00, by calling 488-2708. The twelve winning entries were: Rhiannon Vokey, Jasmine Brazil, Emily Hibbs, Raymond Whalen, Kayla Dobbin, Rodney Curnew, Nicole Rees-Decker, Rebecca Galway, Tasha Brazil, Raymond Barnes, McKayla Lewis and Brittany Blackwood. The committee would like to thank all those people who participated in this project to make it so successful.


ALTERNATIVE MEASURES

The Bell Island Alternative Measures Program is currently looking for volunteers. This is a group of community volunteers who work with young people between their 12th and 18th birthday, accused of their first time offence.

Volunteers, who usually work in pairs, meet with the young person to discuss the alleged offence. If accepted to this program, they work out a contract of activities that the youth must complete. This could include, but is not limited to, letters of apology, community service work, educational sessions, etc. If all activities are completed to the satisfaction of the committee, the file is forwarded back to the Crown Prosecutor. This young person does not have to go to court, nor does he receive a youth record.

To be a volunteer, you must be at least 21 years of age, arrange for three written references, provide a certificate of conduct (at no cost to you) and take an oath of confidentiality. It is an excellent way of getting involved in the community in a very meaningful way, helping our youth. A commitment of not more than 3 - 4 hours monthly will be normally required.

INFORMATION CONCERNING PEACE BONDS

Procedure To Have A Person Placed Under Bond (Recognizance)

A Peace Bond (Recognizance) is an Order made under Section 810 of the Criminal Code of Canada whereby a Defendant is ordered to comply with specified conditions. These conditions will depend upon the information and evidence given to the Judge or Justice.

The Informant (person applying for a Peace Bond) and / or the Defendant (person against whom the Peace Bond is being applied) may have a lawyer present for these proceedings if they wish.

If the person you wish to have placed under a Bond is your married spouse, you must apply to Unified Family Court, 21 King's Bridge Road, St. John's, if you live within a twenty five mile radius of St. John's.

If the person you wish to have placed under a Bond is an adult and not your married spouse, you must apply to Criminal Division, Provincial Court, 4th Floor, Atlantic Place, St. John's.

Applications for Peace Bonds for all other areas of the Province should be made at the nearest Provincial Court.

Obtain an Application form from the applicable court. There are two types of Applications:
1. Application because you fear another person may do you or your family some personal injury;

2. Application because you fear another person may damage your property.

Complete the form and return it to the Court. Include your name, address and telephone number on the application. Also include the name, address and, if possible, the telephone number and birth date of the person you are seeking to have placed under Bond.

The Court will then advise you of the date this matter will be heard before the Judge or Justice presiding. The Court will also issue a summons to the person you are seeking to be placed under Bond to appear in Court at that time.

On the date set, the Informant MUST appear in the Courtroom before the Judge or Justice presiding and present his / her case. Otherwise the matter will be dismissed. If the Defendant fails to appear, a Warrant will be issued for his / her arrest.

Should the Informant be successful in his / her application for a Bond and the individual breaks that Bond, then that individual can be charged with a criminal offence under Section 811 of the Criminal Code of Canada.

HUMOUR

Last year I replaced several windows in my house. They were the expensive double-insulated energy efficient windows.

This week I got a call from the contractor complaining that the work has been done for a year and I had failed to pay for them.

Boy, oh boy, did we go round and round. I told him no one pulls a fast one on this ol' lady. I proceeded to tell him just what his salesman told me last year;

"In one year they will pay for themselves"

FISH-N-BREWIS

Clift Masonic Lodge #10 will be holding their annual Fish-N-Brewis Takeout on Saturday March 29th. Tickets are $5.00 each per 1 lb tray and can be picked up at the Lodge on Main Street between 12:00 noon and 4:00 p.m.

CHRISTMAS TICKET DRAW

The Bell Island R.C.M.P. Christmas project turned out to be a successful venture. The ticket sales for the Christmas hamper were brisk with the overwhelming support from the community.

The lucky winner was Cpt. Bill Bennett. The proceeds from the ticket sales were then used to provide Christmas day for a family identified through Health and Community Services.
